WR Berkley CEO Rob Berkley said on the firm’s Q3 earnings call that growing noise from reinsurers on social inflation and litigation funding as the 2024 renewals approach “kind of makes you scratch your head and wonder where they've been for the past decade, because these are not new phenomena”.

However true, this ignores the fact that the reinsurers' push for lower ceding commissions stems more from their specific fear of further pain from the soft market 2016–2019 underwriting years than from broader concerns about casualty underwriting.
