AerCap’s response to AIG in $3.5bn lawsuit focuses on ‘total loss’ test

Aircraft lessor AerCap has responded to AIG’s legal arguments in a $3.5bn lawsuit over its all-risk policy, with a key focus on the test that should determine whether the company has suffered a total loss.

AerCap also labelled certain arguments that were made by AIG on behalf of itself and other carriers listed on the policy as “embarrassing” due to lack of particularity, in the latest court documents filed for the case.
