Industry unease over UK Court of Appeal asbestos ruling

The UK Court of Appeal this morning overturned part of a first instance decision over asbestos "trigger" litigation, prompting moves for a last ditch appeal to the Supreme Court and experts warning of legal uncertainty.

The Court of Appeal ruled that an employers' liability (EL) policy which says that it pays out in respect of "injuries sustained" does not respond to the period of exposure.
